A 31-year-old mother of three adopted as a baby from Korea may soon be deported. Known as “Seo,” the woman is in custody at a federal detention center in Arizona after being convicted of theft for the second time, according to the Korea Times. So, how do officials from Immigration and Customs Enforcement (ICE) justify their decision to deport someone adopted by an American family at eight months old? They say they reached the decision to deport Seo because of “the nature of her crimes and on the likelihood of repeat offenses.” … We don’t know what drove her to theft — financial pressures, mental illness? Even if it’s plain bad character, the fact that her adoptive parents surely intended her to grow up as an American shouldn’t be overlooked. Unfortunately, at the time of Seo’s adoption, immigration laws for adoptees were different. Since 2004, the U.S. has automatically extended citizenship to adoptees 45 days after they enter the county. Had Seo applied for U.S. citizenship as an adult, she might not be facing deportation today. For unknown reasons, she neglected to make that decision and is only a green card holder rather than an American citizen. This isn’t a rare situation, however. It’s plausible that Seo didn’t know that she wasn’t a citizen, as many adoptees are unaware of their residency status.

A) The point “we don’t know what drove her to theft” apparently needs to be repeated (even though it should not need to be repeated) and B) disproportionate punishment, anyone?  She steals so she just gets kicked out of the country?  That’s fair in your book?

“An undocumented Florida woman who helped her sister report domestic violence now faces an order of deportation from Immigration and Customs Enforcement, even though her lawyers say she never should have been detected by ICE agents in the first place. The woman, Rita Cote, 25, is married to a U.S. citizen and has four children, all of them citizens. She has no criminal record. But when police arrived to respond to the domestic-violence call on Feb. 16, 2009, law enforcement instead took Cote into custody, detained her for a week and handed her over to ICE. Cote now faces deportation at any time to her native Honduras, which she fled as a child in 1998 to escape Hurricane Mitch and its aftermath. If deported, she could be separated from her husband and children for up to a decade.”

this kind of consequence is routinely raised by both immigration and domestic violence advocates and is routinely dismissed as something that “would never happen” because of police discretion and the importance of encouraging victims of domestic violence to engage with law enforcement.

it happens. a lot. and it means that there’s yet another barrier for immigrant women experiencing domestic violence, even when they’re actively seeking help and protection.

what a great system we’ve constructed to support and encourage women.

of the proposed legislation:

1. the required “counting” of students in public schools—those who documented and those who are not.

2. those who can not produced notorized papers explaining why they don’t have legal documents will be reported to authorities.

3. illegal for Arizona board of regents to accept undocumented students at any state or community college regardless of their ability to pay their own way.

4. the dismantling of state medicated, 

5. the reintroduction of required hospital reporting of undocumented patients

6. illegal for undocumented workers to operate vehicles. will result in prison time (which will inevitably lead to deportation).

7. dismantling birthright citizenship

8. “aggravated taking” of identity (whether the person is real, dead, or even fictitious) will result in 180 days in county jail even if judge sentences “taker” to probation.—this especially targets undocumented workers who often use dead person’s social security number to get work. notice—the only thing that happens when a person uses dead person’s SS is person pays money to government that person will *never get back*. the person who had original SS number is DEAD. and thus can not have benefits collected. (and on a side note: it’s really fucking interesting to me to note that we have a person in the public sphere who is *also* also an “aggravated taker”—his name is Don Draper.)

Manolo is a young person who would be eligible for the DREAM Act. He is a Chinese-American who has lived in Tennessee for almost his entire life. He graduated from high school with honors, and earned a bachelor’s degree from Middle Tennessee State University.

Manolo’s family brought him to the United States from Venezuela when he was very young. And that’s where ICE now wants to deport him to—even though Manolo has no friends or family there and doesn’t speak Spanish.

It gets worse—if they are forced to leave the US, Venezuela may send Manolo’s parents back to China. Meanwhile, Manolo’s younger brother, who is a US-born citizen, would stay in Tennessee.

Help us keep this family together. Sign our petition to keep Manolo and his family in the United States.
