“On January 4, 2012, Marvin was stopped by a police officer while on his way to work to make ends meet for his family. Marvin was arrested for driving without a license. He was taken to Broward Transitional Center in Florida, where he is currently being held. Marvin has been ordered deported by June 4th and can be removed from the country any day now.
Marvin is originally from Guatemala and has been living in the United States for the past 12 years. He is currently 28 years old and has a 5 year old U.S. citizen daughter named Madelyn. Marvin also has 2 younger U.S. citizen brothers and a mother who is a legal permanent resident. Marvin has also been a member of the church Segadores de Vida for the past four years and is loved by his community. Marvin’s daughter and Marvin’s mom have suffered a lot of emotional distress since Marvin was detained.
According to the memo issued by John Morton, Marvin is not a priority for deportation and should be granted favorable exercise of prosecutorial discretion. Marvin is an excellent father whose only wish is to raise his daughter with his wife and family. Madelyn, Marvin’s 5 year old, has already suffered 4 long months without her father and the entire family is suffering. Madelyn deserves to grow up with her father by her side.”
